These Terms of Service (“Terms”) govern your access to and use of the Eco Kitchen Co. website, products, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. Overview

Eco Kitchen Co. (“Eco Kitchen Co.”, “we”, “us”, or “our”) provides e-commerce services, including the sale and delivery of products through our online storefront. You must be at least the age of majority in your jurisdiction to use the Services.

2. Accounts

You may be required to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Orders, Pricing, and Payments

  • All prices are shown on the storefront at the time of purchase and may change without notice.
  • We reserve the right to refuse, cancel, or limit orders at our discretion (including suspected fraud or reseller activity).
  • Payment must be received prior to shipment, unless otherwise stated.

4. Shipping and Delivery

Shipping timelines are estimates and not guarantees. Title and risk of loss pass to you upon delivery (or as otherwise required by applicable law). Additional customs duties, taxes, and import fees (if applicable) are your responsibility.

5. Returns and Refunds

Returns, exchanges, and refunds are subject to our posted policies at the time of your purchase. Where applicable, your statutory consumer rights remain unaffected.

6. Prohibited Uses

You agree not to misuse the Services. This includes, without limitation:

  • Violating any applicable law or regulation;
  • Infringing intellectual property rights;
  • Attempting to gain unauthorized access to systems or data;
  • Using the Services to transmit harmful code, spam, or abusive content.

7. Intellectual Property

All content on the Services, including trademarks, logos, text, images, and product content, is owned by Eco Kitchen Co. or its licensors and is protected by applicable laws. You may not reproduce, distribute, or exploit our content without prior written permission, except as permitted by law.

8. Disclaimers

The Services and products are provided “as is” and “as available,” to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by applicable law.

9. Limitation of Liability

To the fullest extent permitted by law, Eco Kitchen Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services or products. In jurisdictions where limitations of liability are restricted, our liability will be limited to the maximum extent permitted.

10. Indemnification

You agree to indemnify and hold harmless Eco Kitchen Co. and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or violation of these Terms.

12. Mobile Terms of Service (SMS)

The Eco Kitchen Co. mobile message service (the "Service") is operated by Eco Kitchen Co. (“Eco Kitchen Co.”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Eco Kitchen Co.’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Eco Kitchen Co. through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Eco Kitchen Co.. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to EcoKitchen or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Eco Kitchen Co. mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

13. Governing Law

These Terms are governed by applicable laws determined by Eco Kitchen Co.’s operational jurisdiction, without regard to conflict of law principles, except where consumer protection laws require otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when changes were last made. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms, to the extent permitted by law.
